On one side, BATEKS İÇ GİYİM TEKSTİL KAP SANAYİ VE TİCARET A.Ş., located at Çengeldere Mah. Çengeldere Cad. No:195 Beykoz/ISTANBUL (hereinafter referred to as "BATEKS"), and on the other side, the member of the www.ayjeshop.com website (hereinafter referred to as "MEMBER"), have entered into this agreement under the following terms and conditions.
- ESTABLISHMENT OF THE AGREEMENT
After completing the registration process on the website and obtaining the necessary approvals, the MEMBER may start using the www.ayjeshop.com website by entering their email address and password, subject to compliance with the conditions specified in this Agreement (hereinafter referred to as the "SITE").
In case the Agreement is concluded on behalf of a legal entity, the person concluding the Agreement on behalf of that entity acknowledges, declares, and undertakes that they are authorized to perform such an transaction on behalf of the legal entity and, otherwise (in the event of unauthorized transactions), personally accepts responsibility for all resulting transactions.
The MEMBER acknowledges that, starting from the completion of the registration and the use of the SITE, all terms of this Agreement are binding for them. BATEKS reserves the right to modify and make changes to the conditions stated below, in compliance with the legislation or this Agreement, and to inform the MEMBER of these changes.
- RIGHTS AND OBLIGATIONS OF THE PARTIES
The MEMBER agrees, declares, and undertakes to act in accordance with the legal regulations, all conditions specified in the contract, and the rules stated in the relevant sections of the SITE while using the SITE.
The MEMBER declares and undertakes that the personal and other information provided during the registration on the SITE and when making purchases are accurate, and in case this information is not accurate, they will compensate all damages that BATEKS may incur due to the inaccuracy of this information.
The MEMBER cannot engage in actions that prevent or complicate the use of the SITE by other members and visitors, and cannot load or lock servers or databases with automatic programs, nor make misleading attempts on the data.
The risks associated with links (links directing to different websites) provided to visitors on the SITE are the responsibility of the MEMBER. BATEKS only includes these links on the SITE to provide information and convenience to visitors.
The MEMBER cannot use another person's IP address, email address, username, and other information on the Internet, nor can they unauthorizedly access or use other members' private information. Any legal and criminal liability arising from such use is the responsibility of the MEMBER.
It is forbidden to publish any element on the SITE in any other medium or website without the permission of BATEKS.
The relationships between SITE users and other third parties are the responsibility of the individuals.
BATEKS will make the maximum effort to ensure the security and protection of the MEMBER's personal data in compliance with the relevant legislation, including the Personal Data Protection Law No. 6698. The MEMBER's provided personal data will be collected, preserved, processed, and transferred in accordance with the Privacy and Cookie Policy on the SITE. The Privacy and Cookie Policy is an integral part of this Agreement. The MEMBER openly and freely consents to the collection, use, transfer, and other processing of their personal data in accordance with the conditions specified in the Privacy and Cookie Policy, by benefiting from the services offered on the SITE and/or creating an account. In the event of any behavior contrary to the obligations specified in the contract and the laws, the MEMBER accepts that they will bear all kinds of legal and criminal responsibilities arising from the termination of the membership.
- ASSIGNMENT OF THE AGREEMENT
The MEMBER accepts, declares, and undertakes that BATEKS can assign the Agreement to third parties and that they pre-approve the transfer of the Agreement under Article 205 of the Turkish Code of Obligations.
- SCOPE AND EFFECTIVENESS OF THE AGREEMENT
The Agreement will be automatically invalidated upon the termination of the membership or the occurrence of any termination conditions specified in the Agreement without the need for any notice.
The MEMBER acknowledges that BATEKS reserves the right to cancel the SITE membership at any time and will notify the MEMBER of the reason for such cancellation.
While the final purpose of the SITE and the basic services it offers remain the same, BATEKS reserves the right to stop the service, change or cancel the content of the service, including published prices, without any obligation to provide notice. BATEKS may update the membership conditions when necessary, and these updated membership conditions will be effective from the moment they are published on the SITE.
Different rules and obligations may be specified for specific sections in the relevant parts of the SITE. The MEMBER using these sections is deemed to have read and accepted the relevant rules.
6 – GENERAL PROVISIONS
The email address and residence information provided by the member during registration to the website are accepted as the legal notification address for any communication related to this agreement.
Any notification made using the registered email address will be deemed to have reached the member one day after the email is sent by BATEKS.
The member declares, accepts, and undertakes that they have read, understood, and accepted all the articles in this agreement and confirmed the accuracy of the information provided.
YOUR CONSENT FOR SENDING ELECTRONIC COMMERCIAL MESSAGES BATEKS İÇ GİYİM TEKSTİL KAP SANAYİ VE TİCARET A.Ş.
I explicitly consent to the processing of my personal and non-personal information related to my product-service purchases, including all kinds of personal data, by taking necessary measures to protect their confidentiality and in accordance with legal principles, by your company BATEKS İÇ GİYİM TEKSTİL KAP SANAYİ VE TİCARET A.Ş., as well as its partners, business partners, successors, service providers-suppliers (including social media operators), and third parties/organizations determined by them, for legal reasons, for the benefit of general and individual product-service opportunities, and for all kinds of product-service promotion, advertising, communication, promotion, sales, marketing, credit card and membership transactions, information, and applications, such as name, surname, nickname, age, gender, marital status, region of residence, education level, areas of interest, shopping habits and preferences related to all kinds of products, likes, invoice contents, mobile/home/work phone number, device code, technical ad ID information, email address, except for all kinds of card information and location data, by automatic/non-automatic methods for collection, takeover, recording in written/magnetic archives within the foreseeable period both domestically and internationally, storage, preservation, making available, use, updating, changing, merging, rearranging, classifying, explaining, sharing, (domestically and abroad) transferring, and processing in other ways, in line with my informed consent regarding all my legal rights in this matter.

In accordance with the law, I explicitly give my consent for your company BATEKS İÇ GİYİM TEKSTİL KAP SANAYİ VE TİCARET A.Ş. to send various promotions, advertisements, promotions, sales, and marketing for all kinds of products and services, as well as information, transactions, and applications related to store cards, credit cards, and memberships, using SMS/short message, instant notification, social media, and other online advertising networks, automatic calls, computer, phone, fax, email/mail, (if open on my device) Bluetooth-other wireless networks, and other electronic communication tools for commercial electronic messages and other communications."
